Terms of Service

Effective date: 1 April 2026

These Terms of Service ("Terms") govern your access to and use of Surfaceable ("the Service"), a product operated by Growth Mode ("we", "us", "our"), a UK-based agency (growthmode.agency). The Service is provided via surfaceable.io.

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use Surfaceable.

1. Acceptance of Terms

By registering for or using Surfaceable, you confirm that you are at least 18 years of age (or the age of legal majority in your jurisdiction), that you have read and understood these Terms, and that you agree to be legally bound by them. If you are using Surfaceable on behalf of a business or organisation, you represent that you have authority to bind that entity to these Terms.

2. Description of the Service

Surfaceable is a SaaS platform providing:

  • SEO audits — automated technical and on-page analysis of websites
  • AI visibility tracking — monitoring of how brands and websites appear in AI-generated search responses across large language models and AI-powered search engines
  • Reporting and recommendations — structured insights and scoring to support SEO and Answer Engine Optimisation (AEO) strategies

The Service is provided on an "as is" and "as available" basis. Features may change over time, and we reserve the right to modify, suspend, or discontinue any part of the Service with reasonable notice.

3. Accounts and Registration

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at hello@surfaceable.io if you suspect unauthorised access to your account.

We reserve the right to terminate or suspend accounts that violate these Terms, provide false information, or engage in harmful behaviour.

4. Free and Paid Plans

Free Plan

Surfaceable may offer a free tier with limited functionality. Free plans are subject to usage limits, which we may adjust at any time.

Paid Plans

Paid plans are billed on a subscription basis (monthly or annually) via Stripe. By subscribing, you authorise us to charge your payment method on a recurring basis at the rate applicable to your chosen plan.

Billing and Renewals

  • Subscriptions renew automatically unless cancelled before the renewal date
  • You will receive notification of any price changes at least 30 days in advance
  • All prices are displayed exclusive of VAT unless stated otherwise. UK VAT may apply where required by law.

Cancellation

You may cancel your subscription at any time from your account settings or by emailing hello@surfaceable.io. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until that date.

Refunds

We do not offer refunds for partial periods of subscription use. If you believe you have been charged in error, please contact us within 14 days of the charge and we will investigate in good faith.

5. Acceptable Use

You agree to use Surfaceable only for lawful purposes and in a manner consistent with these Terms. You must not:

  • Submit URLs or domains you do not own or have permission to audit
  • Attempt to reverse-engineer, scrape, or extract data from the platform in bulk
  • Use the Service to conduct activities that are illegal, harmful, or abusive
  • Attempt to circumvent usage limits, access controls, or security measures
  • Use the Service to infringe the intellectual property rights of third parties
  • Resell or sublicence access to the Service without our prior written consent

We reserve the right to suspend access if we reasonably believe your use violates these Terms.

6. Intellectual Property

Our Property

All software, designs, algorithms, branding, and content that make up Surfaceable are owned by or licenced to Growth Mode. Nothing in these Terms transfers ownership of any intellectual property to you.

Your Data

You retain ownership of the data and content you submit to the Service, including the domains and websites you audit. By using the Service, you grant us a limited licence to process that data solely to provide and improve the Service.

Output and Reports

Reports and audit outputs generated by the Service are for your own business use. You may share them with clients or colleagues, but you may not resell them as a standalone product or represent them as independently produced without attribution to Surfaceable.

7. Limitation of Liability

To the maximum extent permitted by law:

  • The Service is provided without warranties of any kind, express or implied, including fitness for a particular purpose or uninterrupted availability
  • We are not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service
  • Our total aggregate liability to you in any 12-month period shall not exceed the greater of £100 or the total fees you paid to us in that period

Nothing in these Terms limits liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under English law.

8. Third-Party Services

Surfaceable integrates with third-party services including Stripe, Supabase, Vercel, and OpenRouter. These services are subject to their own terms and privacy policies. We are not responsible for the actions or availability of third-party providers.

9. Termination

We may suspend or terminate your account with immediate effect if you breach these Terms, or with reasonable notice if we decide to discontinue the Service. You may terminate your account at any time by contacting hello@surfaceable.io.

Upon termination, your right to access the Service ceases. We will handle your data in accordance with our Privacy Policy.

10. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or in-app notice at least 14 days before they take effect. Continued use of the Service after that date constitutes acceptance of the updated Terms.

11. Governing Law and Disputes

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or your use of Surfaceable shall be subject to the exclusive jurisdiction of the courts of England and Wales.
